Terms And Conditions

1. Bookings
All bookings made with DASL Limited later referred to as “we” and “us” are on the basis of the following terms and conditions. Reference to “you” and “your” means all persons named on the booking form including any additions amendments or alterations made at a later date. Bookings can only be made online using the website booking form. A non-refundable 25% deposit (€150 minimum per week) is required from the person making the booking (the “party leader” - who must be at least 21 years of age at the time of booking) and is payable only by credit/debit card or PayPal. If the booking is made 56 days (8 weeks) or less from the starting date payment in full is required. In making a booking the party leader confirms that he/she has read understands and confirms acceptance of these booking terms and conditions for and on behalf of all persons named on the booking form. On receipt of the deposit or full payment confirmation will be sent to the party leader by e-mail - please check this carefully and advise us immediately if anything appears to be incorrect as it may not be possible to make amendments or alterations at a later date. We reserve the right to refuse taking a booking.

2. Final Balance
The final balance is due with us not less than 56 days (8 weeks) from the starting date of your booking and is payable by electronic/online/telephone banking or bank/wire transfer (Chaps/Swift/BACS) or by debit card (Switch/Maestro 6759 cards only). All other debit/credit cards and PayPal payments will be subject to a 3% processing charge. Please note that no reminders will be sent - if the final balance is not received on time and in full we reserve the right to treat your booking as being cancelled by you (see clause 8).

3. Prices Charged
The prices charged are those prevailing at the time of booking. Once we receive your deposit the price is fixed and guaranteed against future change. However we reserve the right to increase or decrease the prices of any unsold periods at any time and we further reserve the right to correct any errors if any are made. Unless stated otherwise the price includes the cost of gas electricity water and the standard services of the local maintaining agents (who prepare the property for your stay and maintain the property gardens and swimming pools where appropriate). At the properties where gas and electricity is not included in the price you may be required to record initial and final gas/electricity meter readings to enable your usage to be calculated (some properties may require a gas/electricity usage deposit to be paid with the final balance). We will calculate your usage cost and deduct this from your deposit and advise the balance due from you or refund the balance to you.

4. Security Deposits
A security deposit of €150 is required per property and will be included in the final balance due not less than 56 days (8 weeks) from the starting date of your booking. This is normally refunded within 56 days (8 weeks) of the end of your booking. We reserve the right to deduct for any losses breakages or damage caused to the property during your stay and to deduct for the cost of extra cleaning if the property is left in an unreasonable state. If there are any charges or costs in excess of the security deposit upon request you will be immediately required to settle these or reimburse us in full. You should endeavour at all times to replace any breakages with like-for-like replacements before you leave.

5. Travel Insurance
It is a condition of our accepting your booking that you must have adequate travel insurance for the duration of your stay. We require written evidence of this not less than 56 days (8 weeks) before the starting date of your booking. We reserve the right to cancel your booking if we are not satisfied that you or any member of your party has adequate travel insurance. It is your responsibility to check that the travel insurance you take out is adequate for your particular needs and to take out additional cover if required. Please read your travel insurance policy carefully before departure and remember to take it with you whilst you are away. We cannot accept responsibility for any loss damage or personal injury during the period of your booking however caused.

6. Change of Dates by You
If you or any member of your party wishes to change the dates of your booking the party leader must advise us by telephone as soon as possible and thereafter in writing by fax or e-mail. If the property originally booked is available for your new choice of dates an amendment fee of €60 will be due and payable in addition to any increase in the cost of the new period. If we are advised of the change of dates 56 days (8 weeks) or less from the starting date of your booking the cancellation charges and conditions as set out in clause 8 will apply and be payable by you. If the weekly cost of the new dates is lower than that of the original dates only the deposit for the new dates will be considered paid and only to a maximum number of nights equal to that of the original dates.

7. Change of Accommodation by You
If you or any member of your party wishes to change the choice of accommodation of your booking to another property the party leader must advise us by telephone as soon as possible and thereafter in writing by fax or e-mail. The new choice of accommodation will be considered a new booking (whatever dates are chosen) the original booking will be cancelled and the cancellation charges and conditions as set out in clause 8 will apply and be payable by you.

8. Cancellation of Booking by You
If you or any member of your party wishes to cancel your booking the party leader must advise us by telephone as soon as possible and thereafter in writing by fax or e-mail. The cancellation will only become effective from the date it is received by us in writing by fax or e-mail. All cancellations are subject to a charge payable by you which is expressed below as a percentage of the total price (including all extras) except for travel insurance premiums which are non-refundable:

If the cancellation results from illness or certain other unavoidable causes you may be able to re-claim the cancellation charges from your travel insurance. However you must pay the appropriate cancellation charges to us in full before making an insurance claim and these charges must be paid even if you have not at the time paid the full cost or final balance of your booking for whatever reason.

9. Changes by Us
We take great care to ensure our property details and descriptions are as accurate as possible. However we reserve the right to make changes to property details and to correct any errors if any are made at any time. If we have to change your accommodation for any reason whatsoever we will do our best to provide similar accommodation to that booked. This would be considered a minor change - no compensation is payable for minor changes and minor changes do not entitle you to cancel the booking change the booking dates or change the accommodation without paying the cancellation charges as set out in clause 8. If we are not able to offer similar accommodation to that booked provided the change does not occur from circumstances amounting to force majeure (see clause 12) you will have the choice of either: i) accepting the alternative accommodation offered (and receiving any refund in respect of any difference in price between the cost of the properties); ii) changing the booking dates and/or property (and paying for or receiving a refund in respect of any difference in price between the bookings); iii) receiving a full refund of all monies paid to us. This would be considered a major change and compensation on the following scale would apply and be payable from us to you:

Please note that our liabilities in respect of a major change are in all cases limited to offering you the above choices and where applicable the above compensation payments. We regret that we are unable to meet any expenses or losses you suffer as a result of a change however caused.

10. Cancellation by Us
We reserve the right to cancel your booking even after it has been confirmed. However we will not cancel your booking 56 days (8 weeks) or less from the starting date of your booking unless you have failed to make the final payment on time or we are forced to do so from circumstances amounting to force majeure (see clause 12). In circumstances where we do cancel your booking 56 days (8 weeks) or less from the starting date of your booking other than for the reasons listed above you will be entitled to either: i) change the booking dates and/or property for another (and paying for or receiving a refund in respect of any difference in price between the properties and/or dates); ii) receive a full refund of all monies paid to us. In addition to either of these options compensation as set out in clause 9 would apply and be payable from us to you.

11. Your Responsibilities
You are responsible for the property and its contents during the entire period of your booking and are expected to take all reasonable care of it. You are responsible for leaving the property in a clean and tidy condition. You are also responsible for any damage to the property and/or its contents or to any Third party visiting the property which is caused by you any member of your party or any person you invite to the property.

12. Force Majeure
For the specific purposes of these booking terms and conditions force majeure is deemed to mean unusual and unforeseeable circumstances beyond our control the consequences of which could not have been avoided even with the exercise of all due care.

13. General
a) The photographs particulars and descriptions in our property details are for guidance only and do not constitute nor constitute part of an offer or contract. As all properties offered are privately owned it is possible that changes both internally and externally may occur without our prior knowledge. We cannot be held responsible for any items of furniture chattels or decoration either internally or externally that have been removed altered or changed.

b) Only the persons named on the booking form will be allowed to occupy the accommodation. Under no circumstances is the maximum number of people (as stated for each property) to be exceeded without our prior written permission. We reserve the right to refuse admittance should the maximum occupancy be exceeded. Under no circumstances are pets animals or the like permitted into the property at any time without our express written permission.

c) We are unable to accept responsibility however caused for: i) any kind of disturbance or inconvenience at any time including but not limited to: the failure of any local services for any length of time such as the supply of gas electricity water or cable/satellite television; the condition of roads and tracks (some country properties in this area have final access via a dirt track) or roadworks; the availability of swimming pools (which cannot be guaranteed but are normally available from Easter through October); the availability and/or condition of BBQ’s; ii) injury or damage resulting from the use of any gas or electrical appliance or any other piece of equipment in the property; iii) the quality and/or quantity of linen and/or towels (which are provided locally by the maintaining agents whom you should inform directly of any deficiencies in this regard); iv) the change or loss of any view from the property whether temporary or permanent; v) the availability of local amenities (which operate outside our control and therefore cannot be guaranteed by us).

d) If you have any problems during your stay you should bring them to the attention of the local maintaining agents who will endeavour to put them right at the time. If your problem cannot be put right by the local maintaining agents please telephone us and if necessary leave a message which should include a telephone number and time when we can call you up to 24hrs. later. If we or the maintaining agents cannot resolve your problem please write to us immediately upon on your return - we must receive such correspondence from you within 7 days of the end of your booking by fax or e-mail. If you fail to follow this procedure we will not accept responsibility for any future claim as we will have been denied and/or will have lost the opportunity to investigate and/or resolve any such problem.
